Are train horns legal in South Dakota?
Installing an aftermarket train horn on a private vehicle in South Dakota is not prohibited. SD train horn law is in SDCL §32-15-10 — Horn and warning device required — paired with §32-15-11 barring unauthorized sirens, whistles, and bells. Standard UVC pattern: 200-ft audibility, “unreasonably loud or harsh sound” ban, use limited to safe-operation cases.
Install is legal; use on SD public roads — Sioux Falls, Rapid City, Aberdeen, Brookings, Watertown — is the regulated behavior.
What SDCL §32-15-10 actually says
Every motor vehicle when operated on a highway shall be equipped with a horn in good working order and capable of emitting sound audible under normal conditions from a distance of not less than two hundred feet. No horn or other warning device may emit an unreasonably loud or harsh sound. The driver of a motor vehicle shall, when reasonably necessary to insure safe operation, give audible warning with the horn, but shall not otherwise use the horn when upon a highway.
Operative rules: 200-ft audibility · no unreasonably loud or harsh sound · safe-operation use limit · §32-15-11 siren/whistle/bell ban.
Does the factory horn need to stay working in SD?
Yes. §32-15-10 applies to the vehicle as a whole.
Is a train horn a “whistle” under SDCL?
- ·Siren — variable-pitch tone
- ·Whistle — single-tone pressure device
- ·Bell — fire / warning bell
- ·§32-15-11: emergency exempt
- ·Multi-note chord, not a whistle tone
- ·Install not banned
- ·Use subject to "unreasonably loud" test
- ·Factory horn must remain functional
Portable and battery-powered train horns in SD

Enforcement in practice
South Dakota is broadly permissive. Sioux Falls and Rapid City see complaint-driven enforcement; rural counties and West River rarely cite.

- 04 Reserve use for off-road / farms / private property
